New Castle County Superior Court

Felony DUI cases in New Castle County are heard at the Superior Court housed inside the Leonard L. Williams Justice Center at 500 N. King Street, Wilmington, DE 19801. The main court number is (302) 255-0800. Public counter hours run Monday through Friday from 8:30 a.m. to 4:30 p.m. Superior Court has original and exclusive jurisdiction over third offense and higher DUI charges, plus serious DUI-related vehicular assault cases.

The Justice Center is also home to the Court of Common Pleas, Family Court, and a Justice of the Peace Court. A first or second DUI from anywhere in New Castle County typically lands at Court of Common Pleas. A third or later offense, or a vehicular assault or vehicular homicide charge tied to a DUI, goes up to Superior Court. Specialty courts also operate out of the Justice Center, including drug court, mental health court, and Veterans Treatment Court. These diversion dockets can change how a New Castle County DUI record is disposed.

Superior Court uses Form ADM_ADM_03_A for formal record requests. Download it from the Delaware court forms page. Public access terminals at the courthouse let you search the case index for free. The clerks cannot run a search on your behalf, but they can point you to the right terminal and show you how to print a docket. Fees apply per page for copies, with certified copies costing extra.

The Delaware Courts New Castle County portal is a helpful self-help resource. It walks you through CourtConnect, record request forms, and the procedures for getting DUI case details. Full names, case numbers, and approximate filing dates speed up the search. Mail requests are accepted if you cannot appear in person, and a written request letter with identifying info should be sent to the clerk of the court where the case was filed.

Specialty courts inside the Justice Center include drug court, mental health court, and Veterans Treatment Court. New Castle County Police DUI Records

The New Castle County Police Department runs its Records Unit at 3601 N. DuPont Highway, New Castle, DE 19720. Phone is (302) 395-8171. Hours are Monday through Friday, 8:30 a.m. to 4:00 p.m. The unit handles arrest reports, traffic crash reports, and traffic citations, all of which contain DUI arrest details. Active warrants and sex offender information are also available through the Records Unit.

NCCPD is one of 20 Delaware police agencies with Drug Recognition Experts. DREs evaluate drivers for drug impairment where a breath test alone is not enough. Reports from DREs form part of the DUI case file and are central to ยง 4177 prosecutions involving drugs or a combination of drugs and alcohol.

New Castle County police also participate in OHS-funded DUI checkpoints. A checkpoint in New Castle County on September 26, 2025 screened 228 vehicles, made 5 DUI arrests, and produced 12 other traffic arrests. A Thanksgiving 2025 checkpoint stopped 308 vehicles, made 5 DUI arrests, and added 19 traffic arrests. The Delaware state news site carries the official press releases from those operations.

Delaware State Police in New Castle County

Delaware State Police split New Castle County coverage across several troops. Troop 1 patrols the Wilmington area. Troop 2 works northern New Castle County and Delaware City. Troop 6 covers Newark and the Route 72 corridor. Troop 9 handles Middletown and southern New Castle County. All four troops file DUI arrests that end up at the Justice Center in Wilmington. DSP patrols I-95, I-495, U.S. 13, Route 40, Route 72, and Kirkwood Highway, which are all frequent DUI stop locations.

The DSP newsroom posts press releases with defendant names, charges, bail amounts, and court assignments. For serious DUI cases, that press release often links back to the court file by case number. DSP's Collision Reconstruction Unit investigates DUI-related fatal and vehicular assault crashes. Victim Services operates 24/7 at 1-800-VICTIM-1.

A November 2025 incident documented by DSP involved a Dover woman who crashed on North DuPont Highway near Christiana Road in New Castle, killing her passenger, and was charged with vehicular homicide and DUI. A separate January 2026 investigation looked at a fatal pedestrian crash involving a driver from New Castle who showed signs of impairment. Both cases are part of the county DUI record inventory at the Justice Center.
