Delaware Counties

Delaware has three counties. Each county has its own Superior Court, Court of Common Pleas, and Justice of the Peace Courts that handle DUI cases filed within that jurisdiction. Superior Court hears felony DUI at third offense and above. Court of Common Pleas hears first and second offense DUI. Justice of the Peace Courts handle bail, arraignments, and first offender elections. All three counties feed into the statewide CourtConnect database.
